Misleading Lease? Dubai RDC Now Allows Contract Annulment Before Handover
Landlords and tenants in Dubai can now officially annul a rental contract before the tenancy begins if the agreement was secured through deception or deliberate misrepresentation.
The Dubai Rental Disputes Centre (RDC), the judicial arm of the Dubai Land Department (DLD), established the binding judicial principle on October 29, 2026.
Who the Ruling Applies To
The decision directly impacts both property owners and tenants entering into fresh lease agreements across Dubai.
If either party relies on false statements, hidden facts, or deceptive terms to induce the other into signing, the agreement can be legally wiped clean before handover occurs.
The Legal Framework
The ruling is grounded directly in the UAE Civil Transactions Law, specifically Articles 170 through 173, which mandate that valid legal contracts must rest on truthful information and genuine mutual consent.
Awatif Al Khouri, senior Emirati advocate and founder of Awatif Mohammad Shoqi Advocates and Legal Consultancy, noted that the statutory provisions emphasize absolute transparency at the point of signing.
“If one party uses deliberate misrepresentation or deception to induce the other into signing, the misled party is legally entitled to demand the annulment of the agreement,” Al Khouri stated.
Annulment completely voids the contract under the law, resetting obligations before key handover or physical occupancy takes place.
