UAE Labour Law: The 90-Day Limit on Alternative Job Duties
Getting handed tasks that have nothing to do with your employment contract can throw your workday into complete chaos. If you are wondering whether your boss can legally shift your daily responsibilities on a whim, the short answer is that the rules draw a very sharp line.
Under UAE employment regulations, companies cannot simply rewrite your job description whenever it suits them. Legal expert Mohammed Ebrahim Al Shaiba notes that the framework governing these duties is tightly bound by federal legislation.
What the Law Says About Alternative Work
Your employment contract is a binding agreement, which means sudden shifts in your daily tasks are treated as strict exceptions rather than standard practice. Article 13 of Cabinet Resolution No. (1) of 2022 sets down the exact boundaries for this. An employer can only assign you work that differs from your agreed contract when circumstances genuinely necessitate it.
Those exceptional circumstances are specific. They include situations where alternative tasks are strictly required to prevent an accident or to remedy damage caused by the employee. Even when those conditions are met, the assignment comes with a hard ceiling.
The law caps this alternative work at a maximum of 90 days per year. If an employer pushes you outside your contractual duties past that threshold, they are operating outside the legal framework.
Workplace Rules for Larger Firms
If you work for a company with a larger headcount, the organizational requirements are even more formalized. Establishments employing 50 or more staff members are legally required to set up clear internal rules governing how work is structured.
These mandatory regulations must explicitly outline daily working hours, weekly rest days, and official holidays. They also need to detail the precise safety measures and precautions put in place to avoid work injuries and fire hazards. Additionally, companies of this size must document clear criteria for promotions and rewards, keeping workplace expectations transparent for everyone on the payroll.
