50% Cap Put on Salary Deductions Under UAE Labour Law
UAE employers cannot legally cut your pay slip on a whim. Under Federal Decree-Law No. 33 of 2021 on the regulation of labour relations, company management can only dock wages under seven specific conditions outlined in Article 25 of the law. Even when multiple violations or obligations overlap in a single month, your total salary deduction cannot exceed 50 per cent of your monthly wage.
7 Legal Grounds for Salary Deductions
Your employer can only withhold or deduct funds from your salary in the following seven scenarios:
- Loan Repayments: If your employer grants you a loan, repayments can be deducted directly from your salary. However, the company must obtain your written consent first, and the loan cannot carry any interest.
- Recovering Overpaid Salary: If the company accidentally pays you more than your entitlement, Article 25 (2) allows management to recover the excess. The monthly deduction for overpayment cannot exceed 20 per cent of your wage.
- Retirement Contributions and Insurance: Mandatory or legal contributions toward retirement pensions, statutory benefits, and employee insurance schemes governed by UAE law can be deducted directly.
- Approved Savings Funds: Salary can be withheld for worker contributions to an establishment’s savings fund or to repay loans taken from such a fund. This fund must be formally approved by the Ministry of Human Resources and Emiratisation (MoHRE), and you must opt in with written consent.
- Disciplinary Penalties: Deductions for workplace violations are permitted, provided they align with your company’s official penalty regulations approved by MoHRE. Any single disciplinary fine is capped at a maximum of five per cent of your wage.
- Court-Ordered Debts: If a court issues a judgment against you for personal debts, your employer must comply with the execution order. Deductions for general debts are capped at 25 per cent (one quarter) of your wage. However, court-ordered alimony payments are exempt from this 25 per cent limit and can exceed a quarter of your earnings.
- Rectifying Workplace Damage: If your mistake or failure to follow instructions leads to the loss, destruction, or damage of company tools, machinery, products, or materials, your employer can deduct money to cover the loss. This specific deduction is capped at five days’ wage per month, unless a competent court approves a higher recovery amount.
