
Your Transport Allowance Stays Intact During Annual Leave, Legal Rules Confirm
Your transport allowance cannot be docked while on leave
If your job offer splits your salary into a basic wage and heavy allowances, you do not have to forfeit those allowance payments when you take annual leave. Private sector employers in the UAE cannot deduct or withhold your transport allowance during annual time off, provided that allowance is written into your employment contract as part of your wage.
Questions often pop up when job seekers see a significant portion of a promised salary assigned to allowances rather than basic pay. Some worry that because they are not actively commuting to an office while on vacation, an employer might strip away the transport portion for those days.
The legal framework leaves no room for that kind of trimming. Federal Decree Law No. 33 of 2021 on the Regulation of Employment Relations governs mainland employment across the Emirates, laying down clear statutory protections for time off. Under Article 29(1)(a) of the law, every employee earns 30 days of paid annual leave for each completed year of service. Article 29(6) reinforces that right by dictating that employees are entitled to their wage throughout that leave period.
Crucially, the definition of what constitutes a “wage” protects your entire paycheck. Article 1 of the law defines a wage as the basic wage plus any cash or in-kind allowances prescribed under the employment contract or establishment bylaws. That definition explicitly covers allowances given to return effort, address hazards, or handle general living costs.
Because the statutory definition of a wage combines both your basic salary and your contractual allowances, your transport allowance forms an integral part of your regular pay. Legal expert Ashish Mehta, founder and managing partner of Ashish Mehta & Associates, clarified that because the law defines wage to include basic pay and prescribed contractual allowances, a transport allowance cannot be excluded from annual leave pay as long as it is set out as part of the wage in your contract.
For job candidates currently reviewing formal offer letters from Dubai mainland companies, seeing a large allowance split should not mean expecting a reduced paycheck while on vacation. So long as the allowance is formally documented in your contract as part of your wage, your monthly payout while on leave matches your standard working earnings.
For existing mainland employees, any attempt by a company to retroactively deduct transport pay during approved leave violates statutory wage rules.
